We are committed to protecting your privacy and handling your personal information and the data and information we obtain in an open and transparent way that complies with Australian privacy laws.

When You register for an AusComply incident reporting and compliance system You can be sure that we have implemented comprehensive security and privacy practices and procedures to ensure that only You, AusComply and those people You authorise can access the data and information we collect and retain.

This Privacy Policy describes our policies and procedures on the collection, use, storage and disclosure of data and information we obtain when You apply to use or use or access the Services provided by AusComply via our website and through our on-demand incident reporting platform (the Services).

Information You Provide

When You register for the Services, we may ask for Personal Information such as your name, company name, ABN, addresses including IP addresses, e-mail address and credit card information. AusComply uses a third-party intermediary to manage credit card processing. This intermediary is not permitted to store, retain, or use your billing information except for the sole purpose of credit card or bank account processing on AusComply’s behalf.

We may also collect information that your browser or mobile device sends when You use or access the Services.

Use of Personal Information

We will only us Personal Information and data to provide and improve the Services. By using the Services, you agree to the collection and use of Personal Information and data in accordance with this Privacy Policy.

AusComply may use your Personal Information for billing, identification and authentication, to contact You about your use of the Services, for research purposes and to generally improve the content and functionality of the Services.

AusComply may also transmit or share Personal Information with its third party technology vendors and data hosting partners to provide the necessary hardware, software, networking, storage, and other technology and services required to operate and maintain the Services. Although AusComply owns the software, code, databases and all rights to the AusComply application, You retain all rights to your Personal Information and the data you enter or collect.

AusComply and any data collected or entered, is stored in commercial Data Centres in Australia.

Use of the Services may involve the collection and retention of Sensitive Information or other Personal Information including biometric data about customers, entrants and other individuals who access your business or premises.

AusComply provides the Services upon condition that You have ensured that individuals have expressly or impliedly consented to the collection and retention of Sensitive Information or that the collection and retention of Sensitive Information is required or authorised by or under an Australian law such as where You consider it unreasonable or impracticable to obtain an individual’s consent to the collection, use or disclosure of Sensitive Information or other Personal Information and You reasonably believe that the collection, use or disclosure is necessary to lessen or prevent a serious threat to the life, health or safety of any individual or to public health or safety.

Quality of Personal Information

AusComply’s system provides for the timely capture of information. All entries are time stamped and logged against individual user profiles. While AusComply endeavours to guide and assist You (through the workflows, structure and content of the system) to remain compliant with legislation, responsibility for the accuracy and veracity of the information captured is Your sole responsibility.

Access to Personal Information

You can securely initiate access and modify or correct Personal Information at any time by accessing our portal with your pre-verified username and password. You acknowledge biometric data stored on Your behalf by AusComply is securely encrypted and cannot be accessed by You.

Cookies

When You use the Services, we use session "cookies" - a piece of information stored on your computer - to allow the AusComply to uniquely identify your browser while You are logged in and to enable AusComply to process your online transactions. Session cookies also help us confirm your identity and are required in order to use the Services. AusComply uses persistent cookies that only AusComply can read and use, to identify You as an AusComply customer and make it easier for You to log in to the Services. Users who disable their web browsers’ ability to accept cookies will be able to browse the AusComply website but may not be able to access or take advantage of the Services.

Information Sharing

Except as described in this Policy, AusComply will not give, sell, rent, or loan any Personal Information to any third party. However, we may disclose such information as necessary to respond to subpoenas, court orders, or legal process, or to establish or exercise our legal rights or defend against legal claims. We may also share such information if we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of our Terms of Service, or as otherwise required by law. AusComply may also provide non-personal, summary or group statistics about our customers, sales, traffic patterns, and related information to reputable third-party vendors, but these statistics will include no personally identifying information.

Children’s Personal Information

The Services are not intended for, nor does AusComply Pty Ltd knowingly collect or store any Personal Information from children under the age of 18 unless that person attempts to or enters a licensed premises, attempts to or enters a business or property that uses AusComply Facial Recognition or attempts to purchase or purchases alcohol or commits any other indictable or summary offence and the recording of that person’s personal or biometric data is reasonably necessary to protect the legal interests of AusComply or You. Personal Information collected for persons under the age of 18 may be restricted and not readily available to general AusComply users.

Integrity and Security of Personal Information

The AusComply system incorporates unique inbuilt procedures and security measures to protect Personal Information from loss, destruction, misuse, unauthorised access or disclosure. These technologies help ensure that your data is safe, secure, and only available to You and to those You provide authorised access. However, no data transmission over the Internet or information storage technology can be guaranteed to be 100% secure.

Adoption, use or disclosure of government related identifiers.

For the security of venues and for purpose of ensuring venue and individual compliance with legal obligations and to verify ID, the Compliance Documents of Your employees or agents or proposed employees or agents may be checked against relevant government databases via a secure and registered API (Application Interface) with the relevant government agency.

Changes to Privacy Policy

AusComply may update this Policy from time to time. Your continued use of the Service constitutes your agreement to be bound by such changes to the Privacy Policy. Your only remedy, if You do not accept the terms of this privacy policy, is to discontinue use of the Services.

Glossary

AusComply means AusComply Pty Ltd ACN 166 510 032 and its successors and assigns.

Compliance Documents may include passports, drivers licence, Medicare card, tax file numbers and other official identifying documents.

Personal Information has the meaning given under the Privacy Act 1988, being "information or an opinion (including information or an opinion forming part of a database), whether true or not, and whether recorded in a material form or not, about an individual whose identity is apparent, or can reasonably be ascertained, from the information or opinion".

Sensitive Personal Information means sensitive information as defined in the Privacy Act 1988 and includes biometric information that is to be used for the purpose of automated biometric verification or biometric identification or biometric templates.

The Services or Services means the services AusComply provides via our website and through our on-demand incident reporting platform.

You/Your means a person or entity approved to use the Services or applying to use the Services and all related bodies corporate and successors or assigns of that person or entity.
